March 14, 2022. Attorney General Tong Announces Settlements with Four Over-The-Counter Hearing Aid Companies.
“'These companies marketed their products as “FDA -approved” when they were not. Over-the-counter hearing aids may be fine options for certain adults with mild to moderate hearing loss, but there is no federal approval of these products right now. Consumers need to research these products thoroughly before spending their money on a product that may or may not provide safe, effective or meaningful hearing assistance,' said Attorney General Tong.”
January 19, 2022. NAAG Responds to FDA’s Comment Request on New Over-The-Counter Hearing Aid Rules.
“In response to a request for comments from the Food and Drug Administration (FDA) regarding new rules regulating over-the-counter hearing aids, NAAG submitted comments encouraging the FDA to take the below steps to ensure that states maintain a role as regulators in this emerging market.”

“Although an over-the-counter medical device might be less expensive, it doesn’t mean it will be effective,” Attorney General Tong said. “If you are looking into such hearing devices, please do your homework to make sure the device actually works and fits your specific needs before spending money on a product that might be worthless.”
